Terms of Use
We have designed TOGER charging stations to provide an efficient and seamless experience for all users. However, arriving at a fully occupied station and finding that fully charged vehicles are blocking all charging points can be highly frustrating. To ensure the efficient use of charging areas and increase access to the service for all users, we are introducing certain rules and an occupancy fee practice.
We envision a future in which fully charged vehicles automatically leave the charging point. Until then, however, we kindly ask vehicle owners to leave the station as soon as possible after the charging process is completed. No one would leave a vehicle parked at a fuel pump for hours; likewise, we would like to remind users that charging stations are shared service areas open to common use.
By using TOGER charging stations, the User shall be deemed to have accepted the following terms
1. PARTIES AND DEFINITIONS
1.1. Parties
These Terms of Use have been entered into between Mionti Enerji ve Teknoloji Anonim Şirketi, residing at Başak Mahallesi, 5. Etap, 2. Kısım, Abdülhamithan Caddesi No:5, 34306 Başakşehir/Istanbul, with tax identification number 6211099577 (hereinafter referred to as the "Company", "Mionti" or "TOGER"), and the natural or legal person benefiting from TOGER charging network services (hereinafter referred to as the "User").
1.2. Definitions
The terms used in these Terms of Use shall have the following meanings:
- TOGER Charging Network: The network of electric vehicle charging stations established, operated and made available for service by Mionti Enerji ve Teknoloji A.Ş. under the Energy Market Regulatory Authority Charging Network Operator Licence.
- Charging Station: A physical location containing AC (slow charging) and/or DC (fast charging) charging units connected to the TOGER charging network.
- Mobile Application: The mobile software application offered under the TOGER brand that enables charging sessions to be started and monitored, payments to be made and accounts to be managed.
- User Account: The personal account created by the User by registering through the TOGER mobile application or website.
- TOGER Wallet: The digital prepaid energy payment system offered by TOGER and usable for charging services.
- TOGER Card: The physical card delivered to the User by TOGER, allowing charging sessions to be started using RFID technology.
- Autocharge: A technology that automatically starts the charging session when the charging cable is connected to a compatible vehicle.
- Occupancy Fee: An additional fee charged where a vehicle is unnecessarily left at the charging station after the charging session has ended.
- Roaming: An access service enabling reciprocal charging services at stations belonging to other charging network operators that have agreements with the TOGER charging network.
- EMRA: The Energy Market Regulatory Authority.
- Open Access Platform: The digital platform established by EMRA on which the station information of all licensed charging network operators is published.
- kWh: Kilowatt-hour; the unit of electrical energy consumed during a charging session.
- Third-Party Service Providers: Independent organizations with which TOGER integrates or cooperates in order to provide its services. These include SMS and email delivery platforms, push notification services, payment infrastructure providers, map and location services, cloud infrastructure services, analytics and monitoring tools, authentication services and similar service providers.
2. SUBJECT MATTER AND SCOPE
These Terms of Use regulate the mutual rights and obligations of the parties concerning the use of the electric vehicle charging service offered through the TOGER charging network. By using TOGER charging stations, registering with the mobile application or obtaining a TOGER Card, the User declares that they have read, understood and accepted all of these terms.
These terms apply to the TOGER mobile application, website (www.toger.co), charging stations and all digital and physical service channels provided by TOGER.
3. MEMBERSHIP AND ACCOUNT CREATION
3.1. Registration Requirements
In order to benefit from TOGER services, the User must register through the TOGER mobile application or website and create a User Account. The User is responsible for providing the personal information requested during registration accurately, completely and in an up-to-date manner.
3.2. Account Security
The User is solely responsible for the security of their account information and password. The User shall be responsible for all transactions and losses arising from the sharing of account information with third parties or from unauthorized access, and the Company may not be held liable for losses arising from such circumstances. The User is obliged to notify the Company immediately upon detecting unauthorized access to their account.
3.3. Accuracy of Contact Information
The User is obliged to ensure that the contact information registered in the TOGER system, including telephone number and email address, is current and accessible. The Company may not be held liable for notification failures or resulting losses arising from the User's failure to keep such contact information up to date.
4. PRINCIPLES GOVERNING THE USE OF THE CHARGING SERVICE
4.1. General Principles
TOGER charging stations are publicly accessible service points open to the shared use of all users. When benefiting from the charging service, Users are obliged to respect the access rights of other users and to use the stations in accordance with their intended purpose.
4.2. Starting a Charging Session
A charging session may be started using one of the following methods:
- By scanning the QR code through the TOGER mobile application
- By presenting the TOGER RFID card
- By connecting the charging cable in vehicles with the Autocharge feature enabled
- Through the applications or cards of operators with which roaming agreements are in place
4.3. Pricing and Charging
The TOGER charging service fee is calculated solely on the basis of the electrical energy consumed (kWh), in accordance with the EMRA Charging Service Regulation. No additional fee is charged under names such as connection fee, session initiation fee, equipment usage fee or similar.
- Separate unit prices are applied for AC (slow) charging and DC (fast) charging stations.
- Current charging tariffs are announced through the TOGER mobile application, website and EMRA Open Access Platform.
- The applicable unit price is displayed to the User before the charging session starts; the tariff in effect at the start of the charging session remains valid until the end of the session.
- The Company reserves the right to update charging service fees unilaterally. Price changes are announced to Users through digital channels before they enter into force.
4.4. Payment Methods
Users may pay the charging service fee using the following methods:
- TOGER Wallet balance
- Registered credit card or debit card
- Contactless payment (at highway stations, within the scope of EMRA regulations)
- Third-party payment systems under roaming agreements
4.5. Responsibilities During a Charging Session
The User is obliged to comply with the following during the charging session:
- Connect the charging cable correctly and safely
- Monitor the charging session through the mobile application
- Comply with the safety and usage instructions displayed at the charging station
- Immediately stop the charging session and inform TOGER customer services if any fault, damage or safety risk is detected at the station
- Not leave any items or equipment other than the vehicle in the charging area
- Act in accordance with the rules and legislation applicable to the area in which the charging station is located
4.6. Maximum Charging Durations
The following maximum charging durations have been established in order to ensure that charging stations remain accessible to all users:
- The maximum charging duration at AC (slow) charging stations is 8 (eight) hours.
- The maximum charging duration at DC (fast) charging stations is 4 (four) hours.
- At DC charging units, the charging session may be terminated when the vehicle battery reaches an 85% state of charge.
If the specified durations are exceeded, the User shall be informed through the mobile application and/or SMS and warned to remove the vehicle from the station.
5. OCCUPANCY FEE PRACTICE
An occupancy fee practice is in force in order to ensure the efficient and fair use of charging stations, increase access to the service for all users and prevent stations from being occupied unnecessarily.
5.1. Conditions for the Occupancy Fee
- After the charging session is completed, the User is granted a free grace period of 15 (fifteen) minutes.
- If the grace period is exceeded, an occupancy fee of 5 (five) Turkish Liras per minute shall be charged.
- The occupancy fee shall apply for a maximum of 90 (ninety) minutes.
- The maximum occupancy fee that may be charged for a single charging session is limited to 450 (four hundred and fifty) Turkish Liras.
5.2. Application During Night Hours
With due regard to Users' comfort, no occupancy fee shall be charged between 23:00 each day and 07:00 the following day. However, even during night hours, Users are encouraged to remove fully charged vehicles from the station, since facilitating access for other Users who may need charging during these hours is a shared responsibility of all Users.
5.3. Collection of the Occupancy Fee
As occupancy fees are not calculated in kWh, they are not deducted from the TOGER Wallet balance. Such fees are collected separately from the credit card or debit card registered in the User's account.
5.4. Refund of the First Occupancy Fee
The first occupancy fee incurred by a User shall, as a gesture of goodwill, be refunded to the User's TOGER Wallet if the User creates a support request through the TOGER mobile application or customer services. This practice is available on a one-time basis in order to allow Users to become familiar with the system.
5.5. Repeated Violations
The accounts of Users who commit more than three occupancy violations in the TOGER system may be temporarily suspended. Suspension is applied in order to preserve the accessibility of the service for all Users and maintain the healthy operation of the system. Reactivation of the account is subject to the User contacting TOGER customer services and providing the necessary undertakings.
6. TOGER WALLET TERMS OF USE
6.1. General Description
TOGER Wallet is a digital prepaid energy payment system offered by the Company. Users may pay charging service fees using the balance they have preloaded into the TOGER Wallet.
6.2. Scope of Validity
The balance loaded into the TOGER Wallet is valid only at stations connected to the TOGER charging network. This balance may not be used at stations of other charging network operators, on third-party platforms, with business partners or for payments relating to products and services other than charging services.
6.3. Package Types
- AC Package: Valid only at AC-type (slow) charging stations.
- DC Package: Valid only at DC-type (fast) charging stations.
- Mix Package: May be used at both AC and DC charging stations.
- Site Package: Valid at AC charging stations specific to a designated location.
- Promo Package: Discounted packages offered for a limited period during promotional campaigns. The validity period and usage conditions of Promo Packages are separately specified in the relevant campaign terms.
6.4. Validity Period
All wallet packages are valid for 6 (six) months from the date of loading. Any unused kWh balance in packages whose validity period has expired is automatically deleted, and no refund or extension is provided. Users may monitor their remaining balance and validity period in real time through the TOGER mobile application and website.
6.5. Refund Conditions
The balance loaded into the TOGER Wallet may be refunded only if all of the following conditions are met together:
- No use, including partial use, must have been made of the loaded balance.
- The refund request must be made no later than 7 (seven) days from the loading date.
- The refund request must be submitted through the TOGER mobile application or customer services.
If any of the above conditions is not met, the refund request shall not be accepted. No refund is available for the used portion of a package that has been partially consumed.
6.6. Wallet Balance in the Event of Vehicle Sale
The following principles apply to the TOGER Wallet balance of Users who sell their vehicles:
- The wallet balance is not refunded due to the sale of the vehicle.
- The existing balance may be frozen in the User's account upon request.
- The frozen balance shall be reactivated if the User acquires a new electric vehicle.
- The frozen balance may not be assigned or transferred to another User, a different account or any third party.
- No cash refund or conversion into another service is provided for the frozen balance.
- The frozen balance shall expire if it is not reactivated within the standard validity period of 6 months from the date on which it was frozen.
6.7. Gift Points and Promotions
Gift kWh or points granted to Users under promotional campaigns have no cash value, are non-transferable and may not be assigned to third parties. In the event of a package refund, promotional rights earned together with the refunded package shall be withdrawn. The refund amount shall be calculated on the basis of the standard unit price without applying the promotional discount.
6.8. Insufficient Balance and Supplementary Payment
If the TOGER Wallet balance is insufficient during a charging session, the outstanding amount shall be collected automatically from the credit card or debit card registered in the User's account. In this way, the charging session is completed without interruption. If no registered payment method is available in the system, the charging session shall be terminated automatically when the available balance is exhausted.
6.9. Selection of Payment Method
Before the charging session starts, the User may select either TOGER Wallet or credit card/debit card as the payment method. The payment method may not be changed after the charging session has started.
7. AUTOCHARGE SERVICE
Autocharge is a technology that automatically starts the charging session when the charging cable is connected to the vehicle at compatible DC and HPC stations.
- In order to use the Autocharge feature, the User must register the vehicle in the system through the TOGER mobile application.
- No additional fee is charged for use of the Autocharge service.
- The User is obliged to cancel the Autocharge registration before selling or transferring the vehicle. Otherwise, the fees for charging sessions carried out by the new vehicle owner through Autocharge may be collected from the account of the former User who failed to cancel the registration.
- Vehicle identification data is processed solely for the purpose of providing the Autocharge service and is protected under the Personal Data Protection Law.
8. ROAMING SERVICE
TOGER may enter into roaming agreements with other licensed charging network operators within the scope of the EMRA Charging Service Regulation. Within the scope of the roaming service:
- TOGER Users may receive charging services at stations operated by other charging network operators with which agreements are in place.
- Users of other operators may benefit from services at TOGER charging stations.
- Tariffs applied within the scope of roaming services may differ from the tariffs applied on TOGER's own network. The applicable tariff shall be notified to the User before the charging session starts.
- The current list of roaming agreements shall be published through the TOGER mobile application and website.
9. RIGHTS AND OBLIGATIONS OF THE COMPANY
9.1. Service Quality
The Company is obliged to provide the technical infrastructure required for the uninterrupted and safe operation of the TOGER charging network and to carry out maintenance and repair activities regularly. However, the Company may not be held liable for service interruptions arising from scheduled maintenance, infrastructure updates, power outages, natural disasters, force majeure events or acts of third parties.
9.2. Obligation to Inform
The Company is obliged to keep information regarding charging station locations, operating hours, technical features, availability status and prices up to date through the TOGER mobile application, website and EMRA Open Access Platform. The Company is responsible for the accuracy of such information at the time it is published; however, it shall not be liable for losses arising from changes in conditions by the time the User arrives at the station.
9.3. Limitations of Liability
- The Company is not responsible for access to the area in which the charging station is located, parking availability or restrictions caused by third parties.
- The Company may not be held liable for losses arising from vehicle-related technical issues, battery faults, charging incompatibilities, the vehicle becoming stranded or traffic conditions.
- The User is responsible for damage to charging units, device failures or losses caused to third parties arising from the User's incorrect or improper use.
- The Company may not be held liable for fraudulent communications sent in the name or appearance of TOGER as a result of hacking, takeover or technical failures affecting the systems of Third-Party Service Providers, or for losses arising therefrom. The Company's liability is limited to cases where it has failed to exercise due care in the selection and supervision of the Third-Party Service Provider.
- The Company shall not be liable for losses suffered by the User as a result of voluntarily sharing personal information, payment information or account access credentials in response to fraudulent communications alleged to have been sent by TOGER.
10. RIGHTS AND OBLIGATIONS OF THE USER
- The User is obliged to use TOGER services in accordance with the law, public order, public morals and these Terms of Use.
- The User is obliged to carry out the charging session in accordance with applicable legislation and the rules of the area in which the charging station is located.
- The User is obliged to monitor the charging session, remove the vehicle from the station as soon as possible after completion and take into consideration notifications sent by TOGER.
- The User is responsible for the accuracy of the information provided to the Company during and after registration and is obliged to compensate losses arising from incorrect, incomplete or outdated information.
- The User is obliged not to damage charging units, cables or station equipment and to use them in accordance with their intended purpose.
- The User is responsible for losses suffered by the Company or third parties due to the User's fault or negligence.
- The User is obliged to immediately notify the Company of any communication allegedly sent by TOGER that appears suspicious, particularly messages requesting personal information, passwords, OTP codes or payment information. TOGER does not, under any circumstances, request passwords, CVV codes, OTP codes or full credit card numbers from Users through SMS, email, telephone or other messaging channels.
11. INTELLECTUAL PROPERTY RIGHTS
The TOGER trademark, logo, mobile application, website design, content, software and all related intellectual and industrial property rights belong to Mionti Enerji ve Teknoloji A.Ş. The User may not copy, reproduce, distribute, modify or use these elements for commercial purposes without the Company's prior written permission.
12. FORCE MAJEURE
Natural disasters, epidemics, war, terrorism, civil unrest, government decisions, legal regulations, power outages, failures in communication infrastructure, cyberattacks, cyberattacks and security breaches targeting the systems of Third-Party Service Providers, service interruptions affecting third-party infrastructure providers and similar extraordinary circumstances beyond the control of the parties shall be deemed force majeure events. In the event of force majeure, the Company may not be held liable for failure to perform its obligations, and such obligations shall be suspended for the duration of the force majeure event.
13. TERMINATION OF THE AGREEMENT AND ACCOUNT CLOSURE
The User may terminate membership and close the account at any time through the TOGER mobile application or customer services. In order for an account closure request to be processed, the User must have paid all outstanding amounts, including charging fees and occupancy fees.
The Company may unilaterally suspend or close the User's account in the following circumstances:
- Repeated breach of these Terms of Use by the User
- Intentional damage by the User to charging stations or equipment
- Misuse of the system, fraudulent activity or attempted unauthorized access by the User
- Where required by applicable legislation
14. EVIDENCE AGREEMENT
In any dispute arising from these Terms of Use, the Company's books, records and documents, together with data stored electronically, shall constitute conclusive evidence within the scope of Article 193 of the Turkish Code of Civil Procedure No. 6100. The parties acknowledge and declare their acceptance of this matter in advance.
15. RIGHT TO AMEND
The Company reserves the right to update and amend these Terms of Use, the amounts of occupancy fees, charging duration limits and TOGER Wallet conditions whenever necessary. Updated provisions shall enter into force on the date of announcement upon being communicated to the User through the TOGER mobile application, website or email notification.
By continuing to use TOGER services after the updated terms enter into force, the User shall be deemed to have accepted the updated terms.
16. GOVERNING LAW AND COMPETENT COURTS
These Terms of Use are governed by the laws of the Republic of Türkiye. In any dispute arising from the application of these terms, Consumer Arbitration Committees shall be competent within the monetary limits set out under Consumer Protection Law No. 6502, while the Istanbul (Çağlayan) Courts and Enforcement Offices shall be competent for disputes exceeding such limits.
17. EFFECTIVE DATE
These Terms of Use shall enter into force when the User registers through the TOGER mobile application or website, uses a TOGER charging station or electronically approves the terms, and shall produce binding provisions and consequences between the parties.
